I keep seeing people selling or gifting/trading dragons on Toyhou.se- claiming that they used the scrying workshop as a "doll-maker"

I feel like this isn't allowed- but I cant exactly find a place where it specifically says "No, don't do that" anywhere.

Other people are buying these dragons to use as ocs without being aware of this site and the policies I did find there, like the ones regarding nsfw art of FR dragons.

@megradisneyy I have taken it upon myself to make a robust reply. I hope it is helpful to you or to other people in the future.

Dragons may be displayed on other websites, such as Toyhouse, as personal use characters. All art using Flight Rising's IP must have "flightrising.com" on or mear the image. Any images that display official art, like scrying workshop images, must additionally have © Stormlight Workshop LLC on or near the image. X (Art Sales Policy #2 & Skin Use Policy #1)

There is no specific rule against NSFW Flight Rising art being created. However, it cannot be distributed, linked to, discussed, or commissioned on Flight Rising. X

While artwork of Flight Rising characters can be commissioned for real world currency, artwork once created cannot be resold. This is because of the following:

Mostly the first two paragraphs in FlightRising's Terms of Use is the most obvious to me. (Emphasis added by me)

Additionally Toyhouse also has rules against selling copyrighted characters. "Do not sell things that you do not own or have permission to sell," is rule 3.2 for example. There is also rule 4.1, "You must provide a direct and accurate link back to the original artist or photographer."
Toyhouse Rules - Character Dispute wrote:
When reporting a character dispute we require the following:
  • At least one piece of on-site evidence (e.g. TH PMs or forum posts) or public evidence (e.g. links to deviantArt comments or public tweets that have not yet been deleted) that the transaction took place between the users in question. Screenshots of private correspondences cannot be accepted as primary evidence as they may be doctored.
  • Screenshots can be used for matching supplementary evidence. A screenshot of the Paypal receipt may be required in the case that cash payment was involved.

Finally and most important is Toyhouse's policy on the use of dollmakers (rule 4.4) as the scyring workshop is technically a dollmaker. Dollmakers are allowed on Toyhouse if the dollmaker site allows, which Flight Rising does. However, that character needs to be marked as a dollmaker and linked back to the website. Additionally sale of dollmaker characters is somewhat prohibited on Toyhouse. (Emphasis mine).
Toyhouse Rules - Useage of Dollmakers/Character Generators wrote:
We do not host trade or sale of doll maker characters or images unless you can verify the following:
  • The doll maker must explicitly permit commercial use of their artwork. Should this permission not be displayed, we assume that it is not permitted.
  • The character must be very clearly and explicitly marked as a doll maker generated character. Should the recipient of a doll maker-generated design dispute the transaction due to not having been informed the character was made on a doll maker, you will be held responsible for refunding the transaction in full.

You can anonymously report players on their Toyhouse user profile for "Improper Credit" if they have a Flight Rising dragon with no link to Flight Risin or are attempting to sell a Flight Rising character for real world money. Trading an FR character fir anither character is also acceptable. Flight Rising characters can be sold for FR currency if the trade is conducted on Flight Rising. Additionally you should also file a ticket to Toyhouse's HelpDesk. Possibly under "Stolen Artwork" and then title the subject as "Copyrighted Character Being Sold Without Permission."
